Lownoise is a website studio operated by Cesar Castillo, doing business as Lownoise Studio, based in Brownsville, Texas (“we,” “us,” or “our”). For questions about these terms, contact us at hello@lownoise.studio.
Lownoise provides website design, visual direction, setup, inquiry and contact flows, booking paths, launch support, and related web services for small businesses, creatives, photographers, service providers, and nonprofits. The scope, deliverables, and timeline for each engagement are confirmed in writing before work begins.
By engaging our services, you confirm that you are at least 18 years old and have the authority to enter into this agreement, including on behalf of a business or organization where applicable.
Project scope is agreed upon prior to the start of any work. A deposit is required to begin. Deposits are processed through Stripe. Once work has begun, deposits are generally non-refundable.
Final payment is due before the website is launched or project deliverables are transferred to the client. Payment terms specific to your project will be stated in your project agreement or proposal.

Timelines may shift if client materials, approvals, or third-party access are delayed. We will communicate any changes promptly.
Depending on your project scope, your website may be built on or connected to third-party platforms including, but not limited to: Vercel (hosting), Cloudflare (DNS and network security), Stripe (payments), Supabase (database or form handling), Resend or similar tools (email delivery), domain registrars, booking tools, and gallery platforms.
Each provider operates under its own terms of service and pricing policies. Lownoise is not responsible for the availability, pricing changes, or policy updates of third-party providers.
You retain ownership of your own content, brand assets, images, and copy — whether provided by you or created specifically for your business and confirmed as yours in writing.
Lownoise retains ownership of reusable systems, frameworks, internal tools, code patterns, templates, and process materials developed or adapted during the engagement, unless otherwise agreed in writing. Work created exclusively for your project and transferred to you at launch is yours to use going forward.
Lownoise does not guarantee specific search engine rankings, traffic volumes, conversion rates, sales, bookings, or any other business outcome resulting from your website. We build thoughtful, professional web presences — outcomes depend on factors outside our control, including your market, content, competition, and ongoing business activity.
The website and services we deliver are provided in good faith and with reasonable care. However, no warranties are made, express or implied, including warranties of fitness for a particular purpose or non-infringement. We do not guarantee that your website will be free from all errors, or that third-party services connected to it will remain uninterrupted or unchanged.
To the maximum extent permitted by applicable law, Cesar Castillo’s total liability to you for any claims related to services provided shall not exceed the total amount you paid for the specific project giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost business opportunities.
You agree to indemnify and hold harmless Cesar Castillo from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the delivered website, your violation of these terms, or your provision of content that infringes on the rights of a third party.
We may update these Terms from time to time. If we make material changes, we will update the date at the top of this page. Continued engagement with our services after such changes constitutes acceptance of the updated terms.
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be resolved in the appropriate courts in Cameron County, Texas.
